Same Sex Marriage

     Same sex marriage was legalized in 2011 in New York State. Since legalization, many issues have arisen in the context of divorcing and separating same sex couples, that are different from challenges facing heterosexual couples.

 

     For example, if a person gave birth to a child prior to 2011, via in vitro, the other parent may have limited rights, unless there was a legal adoption. More recently, the courts have begun to recognize the right of both parents, especially if they are married, to be in the child’s life, despite how the child was brought into a same-sex relationship (adoption, invites, etc.). 

 

     There are a myriad of other issues that affect same sex couples and it is smart to meet with a knowledgeable attorney to learn your rights and to have a better understanding of what to expect in the event of divorce or separation.
